The Company is not responsible for delays, errors, or problems caused by payment processors or financial institutions. You agree to comply with all terms and conditions set forth by your payment processor. Any disputes regarding payment processing should be directed to your payment processor or financial institution.
4.4 Order Confirmation
Once an Order is placed and payment is successfully authorized, you will receive an order confirmation email at the address provided during checkout. This confirmation is not a binding acceptance of your Order until the Company has verified payment, confirmed inventory availability, and initiated order processing. 4.5 Failed Payments
If payment authorization fails, an Order will not be processed. Common reasons for payment failure include insufficient funds, incorrect card information, fraud detection holds, expired cards, or payment processor rejections. If your payment fails, you will be notified via email. You may retry payment using the same or a different Payment Method. The Company is not responsible for delays in order processing resulting from failed payments or repeated authorization attempts.
5. SHIPPING AND DELIVERY
5.1 Shipping Methods and Timeframes
The Company offers worldwide free shipping on all Orders, with typical delivery timeframes of 6-12 business days from the order confirmation date, plus 2-3 business days for order processing and packing. These timeframes are estimates only and not guaranteed. Actual delivery may take longer due to customs clearance, local postal delays, weather, labor disputes, natural disasters, or other unforeseen circumstances beyond the Company's control, particularly for international deliveries. Business days exclude weekends and holidays.
5.2 Risk of Loss and Title Transfer
Risk of loss and title to Products transfer to you upon delivery to the final recipient address provided during checkout. Once the Products are handed to a shipping carrier (or delivery service), the Company is no longer responsible for loss, damage, theft, or delays. You assume all risk of loss from the moment of carrier handoff. The Company is not liable for damage caused by carriers, weather, customs processing, or mishandling during transit unless the Products were shipped in a materially defective or unsafe manner.
5.3 Tracking and Delivery Confirmation
The Company provides a tracking number via email once an Order ships. Customers are responsible for monitoring their tracking status and contacting the carrier directly regarding any delivery issues, delays, or inquiries. The Company will provide tracking information upon request, but is not responsible for inaccuracies in carrier tracking data or delays in tracking updates.
5.4 International Shipping and Customs
For international Orders, the Customer is solely responsible for understanding and complying with all customs regulations, import duties, VAT, taxes, and any other government-imposed charges in their country of import. The Company does not bear responsibility for delays caused by customs clearance, import restrictions, or additional customs-related fees. Some products may be subject to import restrictions or prohibitions in certain countries; the Customer is responsible for verifying legality before placing an Order. The Company is not responsible for Orders seized, delayed, or rejected by customs authorities.
5.5 Undeliverable Orders
If an Order cannot be delivered due to an incorrect address, recipient refusal, or inability to contact the recipient, the carrier will return the Products to the Company at its own discretion. Upon receipt of a returned item, the Company will contact you regarding options: reshipment to a corrected address, a refund minus shipping costs, or store credit. Reshipment fees, if applicable, will be charged to the original Payment Method.
6. WARRANTY DISCLAIMER

6.2 No Guarantee of Quality or Durability
The Company does not warrant that Products will be of merchantable quality, suitable for any particular use, free from defects, or durable for any specific period of time. While the Company strives to provide high-quality jewelry, metal tarnishing, stone loosening, clasp failure, material brittleness, color fading, or other deterioration may occur naturally with age, use, exposure to elements, improper care, or manufacturing variations. The Company does not warrant against normal wear and tear, cosmetic imperfections, or changes resulting from customer use or care.
6.3 No Warranty of Content Accuracy
The Company does not warrant that Website content, product descriptions, images, pricing, availability, or any other information is accurate, complete, current, or error-free. The Company does not warrant that the Website will operate uninterrupted, error-free, or free from viruses or malicious code. Your use of the Website is at your own risk.
7. LIMITATION OF LIABILITY
7.1 Cap on Damages
EXCEPT IN CASES OF FRAUD, WILLFUL MISCONDUCT, OR GROSS NEGLIGENCE BY CORTIVAS GLOBAL LLC, NEITHER THE COMPANY NOR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR THIRD-PARTY SERVICE PROVIDERS SHALL BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE WEBSITE OR PRODUCTS, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 8. INDEMNIFICATION

EACH PARTY SHALL BEAR ITS OWN COSTS AND ATTORNEYS' FEES UNLESS THE ARBITRATOR DETERMINES OTHERWISE. THE ARBITRATOR'S AWARD SHALL BE FINAL AND BINDING AND MAY BE ENTERED AS A JUDGMENT IN ANY COURT OF COMPETENT JURISDICTION.
12.3 Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflicts of law principles. The United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
12.4 Jurisdiction and Venue
For any legal action not subject to mandatory arbitration, you irrevocably consent to the exclusive jurisdiction and venue of the federal and state courts located in Sheridan, Wyoming, and waive any objection to jurisdiction or venue in such courts.
