Effective Date: May 20, 2026
IMPORTANT: This Disclaimer of Warranties provides critical information about what is NOT guaranteed regarding jewelry products purchased from Cortivas Global LLC. All jewelry products are sold 'as-is' without warranties of any kind, except where expressly required by law. Please read this disclaimer carefully before purchasing.
1. DISCLAIMER OF ALL WARRANTIES
1.1 AS-IS SALE
ALL PRODUCTS SOLD BY CORTIVAS GLOBAL LLC ARE PROVIDED ON AN 'AS-IS' AND 'AS-AVAILABLE' BASIS. EXCEPT AS EXPRESSLY STATED IN A SEPARATE, WRITTEN LIMITED WARRANTY DOCUMENT SIGNED BY AN AUTHORIZED REPRESENTATIVE OF CORTIVAS GLOBAL LLC, THE COMPANY MAKES NO WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, REGARDING THE PRODUCTS, INCLUDING BUT NOT LIMITED TO WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, OR QUIET ENJOYMENT.
1.2 No Implied Warranties
You acknowledge and agree that: (a) there are no warranties, express or implied, that the Products will be of merchantable quality, fit for any particular use, or suitable for any specific purpose; (b) the Company does not warrant that Products will be free from defects, damage, or deterioration; (c) the Company does not warrant the accuracy, completeness, or quality of product descriptions, photographs, or specifications; and (d) any and all representations made by the Company regarding Products are provided for informational purposes only and do not constitute a warranty.
1.3 No Warranty of Durability
Jewelry is subject to wear, damage, and deterioration with use and age. The Company does not warrant that Products will be durable for any specific period of time, will withstand normal use without degradation, or will maintain their appearance or functionality indefinitely. The longevity of jewelry is dependent on numerous factors including material quality, construction methods, frequency of use, care and maintenance, exposure to elements, and individual usage patterns, all of which are beyond the Company's control.
2. PRODUCT QUALITY AND COMPOSITION DISCLAIMERS
2.1 Material Quality
While the Company sources jewelry from manufacturers that maintain reasonable quality standards, the Company does not warrant that materials are of any particular grade, quality, or standard. Metal components (gold, silver, brass, stainless steel, alloys, plated materials) may have variations in purity, composition, or finish. Material quality is subject to manufacturing variation and is not guaranteed to be consistent across all Products or Production runs.
2.2 Metal Tarnish, Oxidation, and Discoloration
Precious metals (especially silver) naturally tarnish, oxidize, and discolor over time due to exposure to air, moisture, body chemistry, and environmental factors. This is a natural and normal process. The Company does not warrant that metals will remain shiny, bright, or free from tarnish. Tarnish is not a defect and does not constitute grounds for return or refund. Customers are responsible for cleaning and maintaining jewelry according to standard jewelry care practices.
2.3 Metal Plating
Products with plated metals (gold-plated, silver-plated, rose-gold-plated) will naturally wear and fade with use and time. The plating layer will gradually wear away, potentially exposing the base metal underneath. The Company does not warrant how long plating will last or that plating will not wear away. Plating wear is normal and expected. The lifespan of plated jewelry is significantly shorter than solid metal jewelry and varies depending on usage frequency and care.
2.4 Gemstones and Crystals
Gemstones, crystals, and decorative stones used in Products may be natural, synthetic, lab-created, or imitation materials. The Company does not warrant that stones are genuine, natural, precious, or of any particular clarity, color, or carat weight (if applicable). Stones may be subject to surface coatings, treatments, or enhancements that may wear away or change in appearance over time. Stone color and appearance may vary from product photographs due to lighting, camera settings, and monitor display variations.
2.5 Loose or Shifting Stones
Stones may loosen or shift position during normal use, handling, or cleaning due to vibration, impact, temperature changes, or deterioration of adhesives or settings. The Company does not warrant that stone settings will remain secure indefinitely or that stones will not loosen with time and use. Stone adhesive and settings may fail naturally without being the result of manufacturing defect.
2.6 Acrylic and Plastic Components
Products containing acrylic, resin, plastic, or similar materials are susceptible to scratching, cracking, warping, and discoloration. These materials may become brittle with age or heat exposure. The Company does not warrant that such materials will maintain their appearance, strength, or structural integrity. Acrylic jewelry is typically lower-cost and lower-durability compared to metal or stone jewelry and should be expected to deteriorate more quickly.
3. CLASP, FASTENER, AND STRUCTURAL DISCLAIMERS
3.1 Clasp Reliability
Clasps, closures, and fasteners are subject to mechanical failure with use. The Company does not warrant that clasps will remain functional indefinitely, will not break or wear, or will reliably open and close throughout the life of the Product. Clasp failure is a normal wear item and is not considered a manufacturing defect unless the failure occurs within the first 30 days of receipt due to pre-existing defects.
3.2 Bent or Damaged Posts and Hooks
Earring posts, hooks, hinges, and similar components may bend, crack, or break with use. The Company does not warrant that these components will remain straight, intact, or functional throughout the life of the Product. Bent or damaged posts are common with older jewelry and with frequent use. This is not considered a manufacturing defect.
3.3 Structural Integrity
The structural integrity of jewelry (including joints, welds, and seams) may deteriorate over time due to stress, repeated use, temperature exposure, or chemical exposure. The Company does not warrant that Products will maintain structural strength or will not break, crack, or separate. Jewelry is fragile and should be handled with care.
3.4 Chain Durability
Jewelry chains may break, stretch, or link with age and use. The Company does not warrant that chains will not break or that links will remain secure. Chain breaking is considered normal wear and is not a manufacturing defect unless the chain breaks within 30 days of receipt due to a pre-existing manufacturing defect.
4. APPEARANCE AND COLOR DISCLAIMERS
4.1 Color Variation
Product colors displayed on the Website and in photographs may not accurately represent the actual color of the Product due to: monitor display settings and calibration, camera equipment and lighting conditions, photography software and filters, and natural variation in manufacturing and materials. The Company does not warrant that the actual color of the Product will match the color shown in photographs or on your monitor.
4.2 Photographs Are Not Guarantees
Product photographs are provided for illustrative purposes only and are not representations or guarantees of the exact appearance of the specific Product you receive. Manufacturing variation and material variation mean that actual Products may differ in appearance from photographs.
4.3 Cosmetic Imperfections
Jewelry may have minor cosmetic imperfections, including: small scratches, dust particles, minor discoloration, uneven finishing, or small manufacturing marks. These imperfections are normal and are not considered defects. The Company does not warrant that Products will be perfect or free from cosmetic flaws.
4.4 Size Variations
Jewelry dimensions and sizes may vary slightly from descriptions due to manufacturing tolerances, material shrinkage, or hand-crafted variations. The Company does not warrant exact dimensions or fit. Ring sizes are estimates and may vary by manufacturer. Customers should understand that actual Products may be slightly larger or smaller than described.
4.5 Aging and Patina
Over time, jewelry develops patina, scratches, and other signs of age. This is natural and expected. Patina is not a defect and does not constitute grounds for return or refund. Many customers prefer the aged appearance of vintage jewelry.
5. USE AND CARE DISCLAIMERS
5.1 No Warranty for Misuse or Negligence
The Company does not warrant against damage caused by: inappropriate use, misuse, negligence, improper care, failure to follow care instructions, impact or dropping, exposure to extreme heat or cold, exposure to chemicals or corrosive substances, prolonged water exposure, or any other damage caused by customer actions or inactions.
5.2 Allergic Reactions
Some individuals have allergies or sensitivities to certain metals or materials. The Company does not warrant that Products will not cause allergic reactions, skin irritation, or other adverse reactions. Customers with metal allergies should research material composition and consult a dermatologist before wearing jewelry. The Company is not responsible for allergic reactions or skin issues caused by wearing Products.
5.3 Discomfort or Skin Irritation
The Company does not warrant that Products will be comfortable to wear or that they will not cause discomfort, pressure, pain, or chafing. Comfort is subjective and varies by individual. Discomfort or skin irritation is not a defect or valid reason for return.
5.4 Care and Maintenance
The Company does not warrant that provided care instructions will preserve jewelry in its original condition or prevent deterioration. Jewelry requires regular care and maintenance to minimize wear. Customers are responsible for cleaning, storing, and maintaining jewelry according to standard jewelry care practices. Failure to maintain jewelry does not constitute a warranty breach.
6. NORMAL WEAR AND TEAR
6.1 Definition of Normal Wear
Normal wear and tear includes: minor scratches and scuffs from contact with other objects, gradual loss of shine or patina development, slight discoloration or tarnish, minor denting or cosmetic damage, slight fading or color change, and any deterioration that occurs from ordinary use. These conditions are not defects and do not constitute grounds for warranty claims, refunds, or exchanges.
6.2 Wear Not Covered
The Company does not warrant against normal wear and tear. Customers should expect jewelry to show signs of use and age. If you wish to maintain jewelry in pristine condition, minimize wearing frequency and increase care efforts.
7. MANUFACTURING VARIATION
7.1 Acceptable Variation
Jewelry items from different manufacturers or production batches may have variations in appearance, dimensions, weight, color, finish, and quality. These variations are normal and expected in handcrafted or semi-handcrafted jewelry. The Company does not warrant consistency across Products or Production runs.
7.2 No Two Pieces Identical
Due to the nature of jewelry production, no two pieces are exactly identical. Customers should not expect received Products to be identical to photographs, product descriptions, or other samples shown on the Website. Minor variations in appearance are normal and not grounds for return.
8. DEFECT CLARIFICATION
8.1 What Is NOT a Defect
The following are NOT considered manufacturing defects and are not covered under any warranty:
- Minor scratches, scuffs, or cosmetic imperfections
- Tarnish, oxidation, or discoloration (normal for precious metals)
- Metal plating wear or fading
- Color variation from photographs
- Minor size or dimension variation
- Signs of wear or age
- Discomfort when worn
- Allergic reactions to materials
- Damage from dropping, impact, or misuse
- Damage from exposure to heat, moisture, chemicals, or environmental factors
- Loose stones after normal use
- Bent or worn clasps, posts, or hooks
- Chain stretching or breaking
8.2 What IS a Potential Manufacturing Defect
A manufacturing defect is a substantial flaw that prevents the Product from functioning as intended or that is present in the Product at the time of delivery (not caused by customer use). Examples may include:
- Complete breakage or separation of a major component (not from impact or misuse)
- Rust, corrosion, or severe deterioration present immediately upon receipt
- Missing or severely defective major component
- Defective packaging that resulted in damage during in-transit
Manufacturing defects must be reported to the Company within 30 days of delivery with photographic evidence and must not show signs of customer use.
9. LIMITATION ON WARRANTY CLAIMS
9.1 No Modification or Repair Warranty
If a Product has been modified, repaired, altered, resized, or adjusted by you or a third party, any warranty is voided. The Company cannot repair or replace items that have been modified.
9.2 No Warranty for Unauthorized Service
If you have had a Product serviced, cleaned, or repaired by a jewelry repairperson or jeweler other than the Company, we cannot verify the quality of the repair or provide warranty for the repaired item.
9.3 Claim Deadline
All warranty claims, including defect claims, must be submitted within 30 days of delivery. Claims submitted after 30 days will not be accepted. The 30-day window is firm and is not extended for any reason.
10. DISCLAIMER OF FITNESS FOR PARTICULAR PURPOSE
10.1 No Fitness Warranty
The Company does not warrant that any Product is fit for any particular purpose, including: fit for daily wear, fit for formal events, fit for professional settings, fit for sports or athletic activity, fit for water exposure, fit for heat resistance, fit for durability, or fit for any other specific use case. Customers are responsible for determining whether a Product is appropriate for their intended use.
10.2 Customer Responsibility
If you have specific requirements (e.g., hypoallergenic materials, waterproof properties, specific durability standards), you are responsible for researching and confirming that the Product meets those requirements before purchase. The Company does not warrant that Products will meet specific use-case requirements.
11. EXCLUSIVE REMEDY
11.1 Exclusive Remedy for Defects
If a Product is found to have a manufacturing defect within 30 days of delivery, your exclusive remedy is (at the Company's sole discretion): (a) replacement of the Product with the same or similar item; (b) a refund of the Product price; or (c) repair of the defect (if feasible). These are the only remedies available for defective Products.
11.2 No Other Remedies
The Company is not liable for consequential, indirect, special, incidental, or punitive damages arising from the use or inability to use any Product, even if the Company has been advised of the possibility of such damages.
12. STATUTORY WARRANTY DISCLAIMERS
12.1 Implied Warranty Disclaimer
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY HEREBY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTY OF MERCHANTABILITY, IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, IMPLIED WARRANTY OF NON-INFRINGEMENT, AND ANY OTHER IMPLIED WARRANTY.
12.2 Disclaimer Validity
Some jurisdictions do not allow the disclaimer of certain warranties or the limitation of liability. To the extent such disclaimers are invalid under local law, the Company's liability is limited to the maximum extent permitted by law.
